OVERVIEW

Welcome to Nightshift Labs Pte. Ltd. (“Nightshift”, “we”, “us”, “our”). We operate this online store and website, including all related content, tools, features, products and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to these Terms, do not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm that you are at least the age of majority in your jurisdiction. You agree to provide accurate and complete information when creating an account or making a purchase. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

SECTION 2 – OUR PRODUCTS

We strive to display our products as accurately as possible. However, colour, tint, or appearance may vary depending on device settings or lighting.

We may modify, discontinue, or limit products at our sole discretion without notice. We do not guarantee that products will meet your expectations or perform identically to digital representations.

SECTION 2A – PRODUCT SAFETY & MEDICAL DISCLAIMER

Our eyewear products are designed for general, non-medical use only. Nightshift Labs does not sell medical devices, prescription eyewear, or products intended to diagnose, treat, cure, or prevent any medical condition.

Nothing on our website or marketing materials should be interpreted as medical advice. Consult a qualified eye-care professional if you have concerns related to vision, eye health, sleep, or any medical condition before using tinted eyewear.

Our orange-tinted lenses may affect colour perception and visibility in low-light environments. For safety reasons:

  • Do NOT use our lenses while driving, cycling, or operating vehicles or machinery.
  • Do NOT use the lenses during activities that require accurate colour recognition or clear visibility.
  • Discontinue use immediately if discomfort or visual strain occurs.

By purchasing or using our products, you agree you are solely responsible for determining whether the product is suitable for your personal use and safe for your intended environment.

Nightshift Labs is not liable for any injury, accident, or damage resulting from misuse or improper use of our products.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase. We may accept or reject any order at our discretion. Orders are only confirmed once payment is processed and acceptance is issued.

Orders are subject to our Refund Policy, which forms part of these Terms.

Purchases must be for personal use only and not for resale, commercial distribution, or export unless explicitly agreed in writing.

SECTION 4 – PRICES & BILLING

Prices may change without notice. Taxes, shipping, and additional charges will be displayed at checkout unless otherwise stated.

You agree to provide accurate payment information and ensure your payment method is lawful and authorised.

SECTION 5 – SHIPPING & DELIVERY

Delivery timelines are estimates only and may vary. Risk of loss transfers to you once the carrier receives the package.

We are not responsible for delays caused by carriers, customs, or events beyond our control.

SECTION 6 – INTELLECTUAL PROPERTY

All content, trademarks, images, logos, designs, product descriptions, and materials on the Services belong to Nightshift Labs or our licensors. You may not copy, reproduce, modify, or distribute our content without prior written permission.

SECTION 7 – OPTIONAL TOOLS

Access to third-party tools or features is provided “as is” and without warranties. Your use of such tools is at your own risk and subject to those third parties’ terms.

SECTION 8 – THIRD-PARTY LINKS

We are not responsible for third-party websites, their content, or any damages arising from visiting them. Please review their terms and policies before engaging.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify, but your purchases are made directly with Nightshift Labs. You release Shopify from any claims arising from your use of our Services or products.

SECTION 10 – PRIVACY POLICY

Your personal information is governed by our Privacy Policy. Some data may be processed by Shopify or third-party partners to operate the Services.

SECTION 11 – FEEDBACK & USER-GENERATED CONTENT

By submitting reviews, suggestions, or feedback, you grant Nightshift Labs a perpetual, worldwide, royalty-free licence to use such content for business purposes.

You represent that any content you submit is accurate, lawful, and owned by you. We may remove content that violates laws or these Terms.

SECTION 12 – ERRORS & OMISSIONS

We reserve the right to correct inaccuracies, errors, or omissions and update information without prior notice, including after an order is placed.

SECTION 13 – PROHIBITED USES

You may not use the Services for unlawful activities, abusive behaviour, infringement, fraud, distribution of malware, or to circumvent security features. We may suspend your access if we suspect prohibited activity.

SECTION 14 – TERMINATION

We may terminate your access to the Services without notice. Relevant sections of these Terms survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES

The Services and products are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including merchantability and fitness for a particular purpose.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Nightshift Labs is not liable for:

  • injuries related to misuse of eyewear

  • colour distortion effects

  • accidents involving vehicle or machinery use

  • indirect, incidental, special, punitive, or consequential damages

  • lost profits, revenue, or data

Your sole remedy is to stop using the Services and discontinue product use.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold Nightshift Labs harmless from claims arising from misuse of the products, breach of these Terms, unlawful activity, or violation of third-party rights.

SECTION 18 – SEVERABILITY

If any provision of these Terms is deemed unenforceable, the remaining provisions remain in effect.

SECTION 19 – WAIVER & ENTIRE AGREEMENT

Failure to enforce a provision does not waive our rights. These Terms constitute the full agreement between you and Nightshift Labs.

SECTION 20 – ASSIGNMENT

You may not assign your rights under these Terms. We may assign ours without restriction.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of Singapore. Any disputes shall be resolved in Singapore courts.
